Nina Butz has a general commercial litigation practice with an emphasis on class actions. She has experience working in fraud and privacy litigation, product liability and consumer protection, as well as environmental and employment law. Nina's work is often national or international in scope and she frequently works with clients facing cross-border litigation. She has worked on several matters before the Ontario Competition Bureau and Ontario Securities Commission. Nina regularly appears before the Ontario Superior Court of Justice and has appeared in the Ontario Court of Appeal and the Supreme Court of Canada.

Nina has worked on several particularly influential cases, including defending a class action involving one of the largest data breaches ever reported and successfully appealing a class action certification order at the Supreme Court of Canada that sought to recognize waiver of tort as a cause of action.

Nina volunteers her time with Pro Bono Ontario's Legal Advice Hotline and has participated in full-representation of pro-bono clients.

Prior to joining Bennett Jones as an associate, Nina both summered and articled with the firm. Nina is a member of the Toronto Lawyers Association, the Advocates' Society, the Ontario Bar Association (Class Action Law Section), the Canadian Bar Association and the American Bar Association. She is also a registered notary public.

Recent Experience

Representation of accounting and law firms in proposed class actions regarding Canada Revenue Agency reassessments of taxpayers who had participated in Canadian charitable-giving tax shelter programs.
Representation of a waste management corporation in an arbitration concerning force majeure claims in the context of the COVID-19 pandemic. 
Atlantic Lottery Corporation, in its successful appeal before the Supreme Court of Canada, which set aside a consumer class action certification order of the Newfoundland and Labrador Court of Appeal. The class action sought disgorgement of profits in the amount of $6 billion through waiver of tort and restitutionary claims, brought on behalf of everyone who has played an ALC video lottery gaming terminal.
Marriott International, in a multijurisdictional, procedurally complex privacy class action involving 16 separate claims, related to the recent data breach of its guest reservation database.
H.M.B. Holdings Ltd., in the tracing and recovery process of US$22 million owed by the government of Antigua and Barbuda following its expropriation of Half Moon Bay Hotel in the B.C. and Ontario courts.
Owners, previous owners and neighbours of contaminated sites.
Corporations and Boards of Directors concerning environmental and regulatory compliance issues and prosecutions.
Bruno Manser Fund, in a potential private criminal prosecution relating to the alleged money laundering in Canada of the proceeds of Malaysian political corruption.
Volkswagen Canada, in defence of consumer class actions relating to emissions of its diesel vehicles.
