Tim Myers practices in the areas of energy regulatory, utilities and rates, environmental, aboriginal, and surface rights law. Tim advises clients in relation to regulatory and environmental aspects of provincially and federally regulated energy and utility businesses and developments across Canada.

Tim's experience includes providing advice and representation in connection with:

  • Facility and associated regulatory approval processes for oil and gas producers, pipeline companies, and electricity and natural gas providers;
  • Environmental enforcement and compliance matters in relation to significant environmental and operational incidents, including experience with environmental protection orders, regulatory enforcement actions, and investigations;
  • Tariff and utility rates proceedings; and
  • Negotiation of surface rights dispositions with landowners for energy developments, and surface rights and expropriation compensation proceedings.

Tim appears before the Canada Energy Regulator; various administrative tribunals in Alberta, including the Alberta Energy Regulator, Alberta Utilities Commission, the Land and Property Rights Tribunal, Metis Settlement Appeal Tribunal, Environmental Appeals Board, and several municipal planning commissions and subdivision and development appeal boards; and, in British Columbia, the Oil and Gas Commission, Oil and Gas Appeal Tribunal, and Surface Rights Board. Tim has also represented clients before the Alberta Court of Queen's Bench, Alberta Court of Appeal, and the British Columbia Supreme Court.

An Ontario-based investor in the $54.9-million sale of certain pipeline and related assets located in British Columbia.

Various confidential clients, with obtaining all necessary regulatory authorizations for the following energy developments in Alberta and British Columbia:

  • 320-kilometre refined petroleum products pipeline
  • Sour gas processing facility and associated acid gas pipeline and acid gas injection well
  • 45-kilometre power transmission line and substation located within a National Park
  • Numerous oil and gas wells, pipelines, and facilities
A confidential client, obtaining all necessary regulatory authorizations for a federally regulated pipeline project.
A gas utility, with several general rate applications before the Alberta Utilities Commission.
Gas and electric utilities, with various rates matters before the Alberta Utilities Commission.
Numerous energy companies, in initial compensation and annual compensation review proceedings before the British Columbia and Alberta Surface Rights Boards.
A confidential client, with an annual compensation review proceeding before the Land Access Panel of the Metis Settlement Appeal Tribunal of Alberta.
Confidential clients, with regulatory enforcement actions and prosecutions in respect of releases and other environmental incidents.
Various clients, with expropriation inquiry and associated compensation proceedings.
Schlumberger Production Management, on the purchase of the Palliser Block assets in Alberta from Cenovus Energy Inc. for cash consideration of $1.3 billion.
